Website Terms of Use

Forefront Experiences Inc., incorporated in Delaware.

These Website Terms of Use (“Terms”) govern your access to and use of www.forefronteducation.com and any successor domain (the “Website”), operated by Forefront Experiences Inc. (“Forefront,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms.

These Terms govern your use of the Website itself. If you enroll a Student in a Forefront Program, that enrollment is governed by our Program Terms and Conditions of Enrollment, which take precedence over these Terms for anything relating to a Program. Our Privacy Policy describes how we handle personal information collected through the Website and in connection with a Program.

1. Who May Use the Website

The Website is intended for use by adults — parents, legal guardians, and Educational Consultants researching or registering a Student for a Program — and by prospective Students within the age range published for each Program. You must be at least 18 years old, or accessing the Website with the involvement of a parent or legal guardian, to submit any form or registration through the Website.

2. Accounts

If the Website allows you to create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at hello@forefronteducation.com if you suspect unauthorized use of your account.

3. Intellectual Property

The Website and its content — including text, graphics, logos, program descriptions, curriculum summaries, and the Forefront name and marks — are owned by Forefront or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may view and print Website content for your own personal, non-commercial use in connection with evaluating or enrolling in a Program. You may not copy, reproduce, republish, distribute, or create derivative works from Website content for any other purpose without our prior written consent.

4. Acceptable Use

You agree not to:

  • use the Website for any unlawful purpose or in a way that violates these Terms;
  • attempt to gain unauthorized access to the Website, our systems, or another user's account;
  • interfere with or disrupt the operation of the Website, including through malware, excessive automated requests, or scraping;
  • misrepresent your identity or affiliation, or impersonate any person or entity; or
  • upload or transmit content that is unlawful, defamatory, or infringes the rights of others.

We may suspend or terminate your access to the Website for any violation of this Section.

5. Third-Party Links and Services

The Website may link to or integrate with third-party websites and services — for example, our payment processor or social media platforms — that we do not control. We are not responsible for the content, accuracy, or practices of any third-party site, and a link to a third-party site does not imply our endorsement of it.

6. Disclaimers

The Website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components. Program details published on the Website are provided in good faith but are subject to change as described in the Program Terms and Conditions.

7. Limitation of Liability

To the fullest extent permitted by law, Forefront and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the Website, even if advised of the possibility of such damages. Nothing in this Section limits any liability that cannot be limited under applicable law.

8. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Forefront and its officers, directors, employees, and agents from and against any claims, damages, losses, and reasonable expenses (including attorneys' fees) arising out of your violation of these Terms or your misuse of the Website.

9. Dispute Resolution: Binding Arbitration and Class Action Waiver

9.1 You and Forefront agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Website (a “Dispute”) will be resolved by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, rather than in court, except as set out below.

9.2 Either party may instead bring a qualifying claim in small claims court, and either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

9.3 CLASS ACTION WAIVER: Disputes must be brought in an individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a representative or class proceeding.

9.4 Right to Opt Out: You may opt out of this Section 9 by sending written notice to hello@forefronteducation.com within thirty (30) days of first accepting these Terms, stating your name and that you opt out of arbitration. If you opt out, neither you nor Forefront is required to arbitrate, and Section 10 governs venue.

9.5 This arbitration agreement is governed by the Federal Arbitration Act. If any part of this Section 9 (other than the class action waiver) is found unenforceable, the remainder of this Section will still apply; if the class action waiver is found unenforceable, this entire Section 9 will be null and void as to that Dispute, and Section 10 will govern.

10. Governing Law and Venue

10.1 These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.

10.2 Subject to Section 9, the state and federal courts located in the State of Delaware will have exclusive jurisdiction over any Dispute not subject to arbitration, and you consent to personal jurisdiction there.

11. General Provisions

11.1 Changes to These Terms. We may update these Terms from time to time; the version posted on the Website governs your use of the Website from that point forward, reflected by updating the “Last Updated” date above.

11.2 Severability. If any provision of these Terms is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.

11.3 No Waiver. Forefront's failure to enforce any provision of these Terms is not a waiver of its right to do so later.

11.4 Assignment. Forefront may assign or transfer its rights and obligations under these Terms, including to an affiliate or successor entity, without affecting your rights under these Terms.

11.5 Entire Agreement. As to your use of the Website, these Terms and our Privacy Policy constitute the entire agreement between you and Forefront; enrollment in a Program is separately governed by the Program Terms and Conditions of Enrollment.
